Prisoner committable
on the
footing of Penitentiary
Prisoner
Art. And whereas it is necessary that it should
be determined what manner of persons may be
committed in quality of Penitentiary-Prisoners to
the said Penitentiary House And whereas
if the undertakings aforesaid of the said inmates thereof
in respect of superior management should come to be fulfilled
it might on divers accounts be advantageous
of advantage as well to for the benefit as well of individual prisoners
as of the public that a power there should be lodged instead
exist in proper hands a power of oc to be exercised on proper
occasions of committing thereto in case of sufficient room therein prisoners of other
descriptions to the in the same manner as to any other prison. And whereas nevertheless
[a power of committing them to prisoners]
the exercise of such power [at the any time and
with respect to any numbers of prisoners without
limitation] without the consent of the said Governor
would might be repugnant to the main purpose end
to which the said Penitentiary House was meant of the said institution
to be adapted and inconsistent with the economy
destined to be carried on practised under the same. Be it
therefore Enacted as follows: viz.
