Contract
Persons who may be committed to the said Prison
in quality of Penitentiary Prisoners are the following,
viz.
1. Any person who either now is or hereinafter
shall in virtue of any Statute present or future either now is or soon shall or might have been under sentence of transportation:

may be shall might have been under sentence of hard-labour
on board any hulk in lieu of lying
or to lie in the River Thames or elsewhere.
3. Any person having accepted of his Majesty's
most gracious pardon on condition of
transportation, provided such priso offender chooses
so to be committed instead of being transported, and
not otherwise.
4. Any person who for any felony is under
sentence of committment to Newgate or any other
prison.

prisoners
Persons who on the Governor's consenting to receive them may be committed to the said
Prison on the footing of ordinary prisoners are
as follows, viz. Governor's requitants
the receive the same are as follows, viz:
Any prisoner who [+] [+] either in execution
or for safe-custody
shall have been sent
thither shall have been sent thither in virtue of his Majesty's pleasure
signified by any of his Majesty's Secretaries of
State, in so far forth as the choice of the prison depends
by law upon his Majesty's pleasure.
Any person who either in exception or for safe custody shall by sentence or warrant of any
Judge or Judges acting within the sphere of their respective
jurisdictions, shall have been sent committed thereto.
