every such offence shall under the reservation aforesaid be
deemed felony.

Art. 3. Any such offence as aforesaid shall be understood to be committed
with force in the cases following viz:

1. If bodily violence be used 1. If on the part of the offender any act to be done or intention indicated
or attempt in the intention of putting in bodily
fear any person who should endeavour to prevent
the unlawful liberation aforesaid:

2. Or if any bodily violence be and employed or intended
to be employed for the purpose of surmounting
any such other obstacles as may tend to prevent
such liberation as aforesaid.

Art 4 For intentionally destroying the Penitentiary
House or any building thereto belonging,
thereto of for intentionally damaging the same in such manner
as to give occasion afford manner a facility of escape to any
Prisoner, imprisonment confinement for life therein or in
such Prison as shall have been built in lieu
thereof if destroyed: for attempting to being concerned about with any other in
attempting to produce effect such destruction or endamagement,
confinement as aforesaid for any
term not greater than ten years nor less than
two years: for making preparation to effect such
destruction or endamagement, confinement as aforesaid
for not more than five years nor less than
one year: and conspiracy though not followed
by any attempt, shall to this purpose be deemed
an act of preparation: and every such offence shall under
the reservation aforesaid be deemed felony.
