Art. 5. For permitting an escape through negligence
on the part of any person employed in the management
of the Prison, Fine, with or without
imprisonment in the same or elsewhere
at the discretion of the Court.

6. For any one who being employed as
to a Guard or Watchman in or about the Prison shall
between sunset and sunrise desert his station
or walk, or be asleep or drunk therein, confinement in
the same for on conviction before one Justice
for any term not greater than a year, or
on conviction by indictment, for life.

Art. 7. And whereas a prisoner committed to
the said Prison for life could thereby be incapable of
further undergoing the punishment aforesaid punishment if temporary
confinement therein and

herein appointed for other fugitives And Whereas capital
punishment (being the usual punishment for
disobedience to a sentence of transportation )
for life) is not necessary in the present case instance
not necessary, and in the case of a desperate
and abandoned Prisoner might operate as an
