so long as none but offences of
the same mischief
are comprehended
under the same punishment
of guilt is kept sufficiently discriminated from the
path of innocence And whereas Justice concurrs with
Mercy in requiring that delinquency should be defined
rather by previous warning than by ex-post
facto ad condemnation Be it enacted that at
the instance of the said Governor the Court of King's
Bench may from time to make rules and orders,
declaratory of such acts on the part of the prisoners
as in consideration of the local circumstances
of the said Panopticon Penitentiary House or
of any other place in which under the authority of the said Governor the said Prisoners
or any of them may come occasionally to be
employ'd shall be deemed Escapes, or Attempts
or Preparations towards escape: in which said

rules and orders, shall to
the end that no one may offend through ignorance, shall
be contained a specification of the manner in which

offends through ignorance: and if due promulgation
shall accordingly have been made, and from
the nature of the case although in that express
evidence it shall appear to the Jury that a
prisoner committing any such act was must have been apprised
that it the same would be deemed an an escape, or attempt or preparation
towards escape he or she shall be convicted deemed guilty
of such escape attempt or preparation as the case is although
no other nor express nor other proof could ever be
produced of the intention to escape shall have been
produced.

Art 17 So in case of an with regard to any
acts which to the said Court may appear indicative
of an intention on the part of any person at
large to promote an escape on the part of the prisoners
or of any prisoner.
