Art. 16 And whereas the lines employed to delineate
the track of delinquency can never be too determinate,
And whereas the greater the number of distinct steps that
can can be marked out therein the greater is the facility
given to detection and conviction And whereas
the prevention of delinquency by cutting off all hope
of impurity is the truest mercy And whereas Justice concurrs with Mercy in requiring that delinquency should be defined rather by previous warning than by ex-post-facto condemnation And whereas so long as none but offences of the same mischief are comprehended under the same punishment And whereasthe
multiplication of penal ordinances is in this way a class safeguard
to be the subject and not a share, so long as the
of guilt is kept kept sufficiently therein still <unclear>forthwith</unclear>
of innocence And whereas Justice concerned with

Be it enacted that at
the instance of the said Governor the Court of King's
Bench may from time to time make rules and orders
declarative of such acts on the part of the prisoners
as in consideration of the local circumstances
of the said Panopticon Penitentiary House or
of any other plan in which under the authority of the said Governor the said Prisoners
or any of them may come occasionally to be
employed shall be deemed Escapes, or Attempts
or Preparation towards escape: in which said
state which said rules and orders, shall to
the end that no one may offend through ignorance, shall
be contained a specification of the manner in which
the same shall be promulgated:⊞2 ⊞2 of which acts an example or contained in the paper marked [G] that no necessary
offend through ignorance: and if due promulgation
shall accordingly have been made, and from
the nature of the case although without express
orders
it shall appear to the King that a
prisoner committing any such act was must have been appeared

that it the same would be deemed an an escape, or attempt or preparation
towards escape he is or she shall be convicted deemed guilty
of such escape attempt or preparation as the case is although
no other or express nor other proof could be were
provided
of the intention to escape shall have been
produced.

large to promote an escape on the part of the prisoner
