Art. 34. And whereas if through any error it should
happen that
if a person who never had been a Penitentiary
Prisoner should through by any mistake be conveyed
thither as a fugitive therefrom or as a deserter from the
Metasylum, the innocence of such prisoner in respect of such charge must be
fully known to all persons employed as officers or otherwise
in an about the said establishment Penitentiary establishment

known and that to a degree of certainty far superior to
any what can in general be obtained in any ordinary
mode of trial
And whereas the confinement
of any such Prisoner in the said establishment untill
the next term of sitting of the Court having jurors
b in which he would be to his bond would be in
much undue punishment inflicted upon the innocent

Be it enacted that in any such case upon
a certificate given by the Chaplain and Surgeon or
any other two Officers of the said Establishment that
the Prisoner is brought to the said establishment as
a fugitive or deserter as aforesaid never had been a
Prisoner belonging to the same the Governor may
forthwith give him his discharge.
