Moreover if before the said Justice or any other
Magistrate, or otherwise, the party so committed
shall have appear to have unlawfully assumed as aforesaid any name
other than what is contained in his said identification-
mark, such Magistrate shall if thereto
empowered by his office proceed to the examination
and committment of the prisoner for the offence
if such assumption as aforesaid: or if not thereto
empowered, shall then cause the said prisoner
to be conveyed before some Justice of the Peace
or other Magistrate so empowered.
