Art 20 All such Books so kept as aforesaid shall be
deemed good evidence as well for as against the
said Governor: and the exhibition thereof as against
the said Governor may in any cause in which he
is party, criminal causes in which he is defendant not
excepted, be compelled: and that in the same manner as if such
Books were in the hands power of hands of any person
not interested in such cause, any rule of law to the
contrary notwithstanding.
Art. 221. And whereas any provision for the compelling
the production of any such such books would might
in the event of any criminal prosecution against the
said Governor be of little avail, if the said Books were
to remain at all events in the absolute power of him the
said Governor without controal, Be it enacted
that the Court of King's Bench may at any time,
either at the proper motion of the said Court or at
the instance of any person whatsoever, take order for
the keeping due preservation of such books in the
custody of some proper and known person or persons
who shall be responsible for the same, and by whom
any legal writ arrests for or order for the production
thereof shall be notwithstanding any order from
the said Governor be obey'd; provided case being taken that the due
keeping of the said Books for the use of the said
Penitentiary House and be not impeded, nor the authority of the said Governor
over such Clerk person or persons, so far as for such purpose shall be necessary for such purpose
be not impaired.
