acts, and consequently of the evils resulting from
them, as appear of the same kind with that for which
it is inflicted. This effects Punishment as far as
it is known to be inflicted, tends in fact in all cases
to produce. And this is the end which upon the
principle of utility it ought constantly to have in
view: the only end which of itself can warrant the
employing it.
As to the evils which it is the proposed end
of punishment to prevent, there are two distinguishable
sources from whence they may flow. 1st. The
conduct of the offender himself and 2dly. the conduct
of persons at large, that is of as many as may have
motives and opportunities to commit offences of
the like kind. Hence the business of prevention may
be divided into two branches – The first respecting
the evils that might ensue from the conduct of the
offender himself may be stiled Particular Prevention.
The other respecting such as might ensue from the
conduct of persons at large – General Prevention.
The business of Particular Prevention may
be pursued in either of two ways: first By ideal restraint
that is by terror which takes away the will desire & the courage to offend,
or secondly, By physical restraint or disablement
which takes away the power. The first of these
methods is commonly the least chargeable: the
second always the most effectual. – It is in the
first of these cases that the measure adopted
is stile a measure of Correction; – or of Reformation
one object of which is to reform the Criminal.
