Expence
It is manifest that if upon delinquents were instantly punishments
punished for their offences, & that inadequate quantity even were invariably made to fall, and nobody
else knew of it, there would be a great deal
of mischief done, and (if omitting the inconsiderable benefit
that would result from from it be produced in the way of disablement
were out of the case be disregarded) not par the least
particle of good. The real punishment would be
as much as ever, & the apparent would be
as nothing. The punishment would fall upon every
man by surprize upon the delinquent it would not have operated
upon from in the way of prevention, and would upon to no one
not have served as an in the way of example. to any one.
Delinquents will know nothing of the punishment
that is provided for them in either of the two cases.
1. Where the command or resoltuion of him from
whose the will the punishment is to ensue has been never
uttered. 2dly Where, though uttered, it has never
been forwarded to their notice adequately promulgated.
The penal denuntiation may be made
presented to the notice of persons in general in
two measures modes. 1st by forwarding the mode of
punishment in question to a mans notice
under its popular and any are accustomed
name. 2. by giving such a by being present
at the time of its execution letting enabling them to read of it
as it is described. 2. by letting enabling them to see it as
it is actually inflicted.
The idea given of the punishment may ought to
be exact, or, as it expressed by logicians, adequate:
by which I mean that it should present to the
mind not a part only but the whole of the
sufferings that it involves.
