VII Subserviency to Reformation

All ca punishments are calculated to produce
intimidation: but if the a delinquents after having
been subjected to them ge be restrained only by fear
is they cannot be said to be reformed: reform, consists
in
as to the first purpose in question, consists in the
producing a change in the disposition and moral
character of the patient.

It is true that whether the however that whether
a punishment operates in the way of reform as of
reform
intimidation or of reformation can rarely
be known to the legislator: the visible effects may be
the same in the one case as in the other: a man by
the dread of a severe punishment may be driven from a course
of delinquency, and to avoid perishing from want,
betake himself to a course of honest industry: in this case
then the life
here then is reformation, but it is
produced not by the quality but by the severity of
the punishment.

Now that all it have to be said From this however it is not to be inferred
that all punishments it is the quantity only, & not the
nature, of the punishment that for the purpose in
question demands attention. Those punishments
have the fr strongest tendency are the most apt to produce reformation that diminish the force of the seductive and augment
the force of the tutelary motives: the irascible they
in offences originating in ill-will punishments that
tender to diminish the force force pungency of the irascible attentions
such as spare diet, will have a reforming seem
most calculated best adapted to produced reform: so i the case of
offences arising from indolence, penal labour.
