in the application of it is entrusted altogether to
the interested caprice of the executioner. This
menial & corruptible servant of the public has
constantly in his power and for a fee will naturally as constantly
have the inclination, to render the punishment
much lighter than it was designed to be by the
Judge, when no fee is given he has it in his
power and of course in his inclination to
make the punishment too heavy. By this
means the suffering of the delinquent depends
upon his guilt but upon his poverty.
By far the greater number of instances in which
the mode of punishment in question is employed
in this country are those of offences of indigence
& rapacity hence this pernicious consequence
is apt to follow. If the delinquent has been
unfortunate & not able to secure his plunder,
or honest honest repents, and has voluntarily gives restores
it up, he then suffers the rg rigor, perhaps more
than the rigor, of the law. Good fortune and
perseverance in dishonesty enable him to buy purchase
an indulgence.

By a very simple contrivance this inconvenience
might in great measure, if not
altogether, be avoided remedied. Let the materials and
dimensions of the rods be paid by law: let
them be of cane or whalebone – of a determined
length figure shape & diameter. Let a number of
such rods project as radii from an axis. Let
the machine be put in motion the body of the
patient being fastened under it: the force of each
blow will be determined by the number of turns revolutions
it the axis is made to perform in a given time, & the
what sum of aggregate amount of punishment will be determined fixed with as great a degree of accuracy as the nature of
things admits of by prescribing the number
