In respect of variability they are scarcely
in a less degree defective. The loss of the eyes
or of the hand is not to a man can neither
read or write the same degree of punishment
as it would be to a Painter or an Author
Yet however different may in each instance be
the degree of suffering.
The different degrees of
severity of which these modes of punishment are
susceptible, various as they are, are far from
being determinate: they vary in themselves but
are not variable at pleasure. It will be true
in general that the deformation disablement or
loss of any two parts is a greater mischief than
the same loss of either of those parts one part without the
others: if this were exactly true in every instance
we should have an exact scale of variation consisting
of as many degrees as there were distinguishable
parts obnoxious to such misfortunes; but this is
not the case. what might take away the
livelihood of the first one person may not affect
that of another.

In respect of exemplarity the
punishments in question harness this property in
a higher degree than simple afflictive punishments
