Imprisonment examined

The distinguishing excellence of the 1st 2d & 3d this group of punishments 6th & 8th is
their subserviency to reformation. These may be
all comprized with sufficient exactness under three peculiar appellations, Solitude,
Darkness and Severe ard Diet.

That they the three hardships thus named have a
peculiar tendency to dispose an offender to penitence,
seems to be the general persuasion of mankind. The
fact seems to be pretty generally believed acknowledged received: but the
reasons are not altogether obvious, nor do they seem
to be very explicitly developed in the sentiments minds of
those who shew themselves strenuously convinced of
the fact. An imperfect theory might naturally enough induce one
to deny it. "What is it", it may be said, "that is
"to produce in the offender that aversion to his offence
"which is stiled repentance penitence? It is the pain which he
"experiences to be connected with it. The greater then
"that pain the greater will be his aversion: but of
"what kind that be this the pain be, or from what source it issues
"are circumstances that make no difference. These Solitude
"three hardships Darkness and Hard Diet will in virtue of a certain quantity of pain thus produced, will produce a
"certain degree of aversion to the offence. Be it so.
"But Whipping, or any other mode of punishment that
"produced a stronger greater pain, would produce a stronger
"aversion. "For the purpose of General example Prevention where the business design is by means of a certain quantity of pain to make an impression on men who have not experienced it a pain of one quality may be preferable to the same quantity of pain of another quality, because the first by an equal quantity of real pain may produce more apparent. But here that pain is not the case. It is the real pain that is to do the business. The patient knows precisely what it is for he has experienced it. or what is Now the pain of Whipping may
"be carried to as high a pitch as the pain produced
"by this groupe of hardships altogether: In what respect
"then can these have a greater tendency to produce penitence
"than Whipping but?
