Simply restrictive
Presence banishment

deprived of his licence, in these ecases the punishment
operates as a pecuniary forf forfeiture, which are
very unequal and unfrugal. When a man
is deprived of the means of gaining his livelyhood
what is to become of him. If he happens to be
the father of a family the punishment operates
not merely upon the offender, but upon all
the contributors to the Poor's rates.

Occasion Employments that are not profit
seeking are amusement seeking: their varieties
their variety of pursuits of this description is infinite: but there is however one
feature in which they all agree and int which
save upon the present occasion at least this will save the necessity of
entering into a minute examnation of them.
There And that is that is not one of them the restriction from
the enjoyment of sufficient magnitude to be
shed relied in trusted of
effect the object aimed at.

In respect of sources of amusement pleasures man is
by his constitution endowed with a very fortunate
flexibility. Debar from him from one source
of amusement and almost instantaneously
he goes in quest of another and scarcely ever
with invariable success he goes in quest of another.
Other habits are readily assumed; the taste conforms becomes reconciled
itself to it to new objects, and conforms itself
to the point fresh scenes that present themselves.
Between individual & individual it is true this elasticity
of the mind and aptitude for adapting it to
the new circumstances novel situations will vary extremely:
but in respect of each individual, it will would
be impossible to determine by anticipation
for how long a time that length of time period
the recollection of his old habits shall continue
to influence his mind so as that the being debarred
from the exercise of them shall continue to operate
as a in the nature of a punishment.
