Punishment analysed.

It is not usual however to take this method of expressing
any modification of active punishments but that above-mentioned
it being a much more ready way to speak, in the affirmative positive way,
of the obligation to do a thing, than in the way of double negation,
by speaking of the loss of the liberty (that is the not having
any longer the liberty) of not doing it.

The only case case in which it would be natural to use this
mode of expression if any such punishments were separately in use
is are where men at large are being liable to the obligation not on the score
of punishment, but as a burthen † See above Chap. 1. which for the purposes of Society
must be laid on somebody, a particular class of persons of
which the party in question was one are exempted from that obligation,
and then the party in question is in the way of punishment
subjected to it anew. Such is the case in the instances
above given. But in this case it is not only more precise but
more common to use the word exemption or the ore general
word privilege, than the word Liberty. Forfeiture of the
exemption from serving in the militia: Forfeiture of the privilege
of not being made to serve in the Militia.
