Pecuniary Forfeitures
2. Pecuniary Forfeiture shares with Penal Servitude
in the striking advantage of being convertible to
profit. The former is capable of producing this
effect in a greater degree but is not so certain of
producing it as the latter. The former where the
condition of the delinquent admitts of it's taking place
may often be made to operate in this way much more than the latter but then the
former it is not every delinquent on whom, although
he be forthcoming, it is certain that the former can be
made to take place: but if he be forthcoming, it is so certain
that the latter can be made to take place, and
upon an average of all the whole number of delinquents
to operate this effect. All men can not be made
to pay: but all men may be made to work; and that
as it should seem in such manner as that the total sum of labour
if all together thus reached shall be made to produce
clear profit.
In point of The quantity of profit is not limited in this case
as in that. This is it's peculiar excellence; and this it
is this that adapts it particularly to the purpose of
compensation.
