Pecuniary Forfeiture.
[There is one case however in which it is particularly
deficient in this article. This is when it is
laid on in under the shape of Costs. The quantity
of the punishment is Upon the face of the
Law It is nothing no sign as expressed nothing occurrs from whence any adequate idea
can be drawn drawnof what eventually turns out to be
the quantum of the punishment.
In point of Popularity, this punishment exceeds
every other. It is the only one of any consequence
against which some objection or other of the popular
cast has not been made.
This case is of very considerable extent and importance.
In [the case of] the greater part number of
the offences of all kinds that are committed, costs
are the only punishment there is in the case constitute the whole of the punishment that is inflicted.
This is the case with all those offences that are stand
prohibited by Laws that which from their want of not
being armed with a punishment formally denounced
under that name, are stand excluded⊞ ⊞ in common speech from the catalogue
of penal Laws. Such are those which serve to by which men are
restrained restrain men from the common run of offences
against property; such to wit as are not attended with any
circumstances of aggravation. Even where there is a
penalty expressly denounced, in many cases [thus the
matter stands under our own Jurisprudence at least,] it bears
