To the grant of a any reversionary interest in an office there
is always this plain and unanswerable objection
therein that the reversioner, how fit soever for the office at
the time Reversion and Joint lives of the proposed reversionary grant may, at the time when the vacancy takes
place, viz. the vacancy by which the reversioner would be
By the very nature of the arrangement terms, without
in any case either to the Officer or the Office
put into possession – have become to any degree unfit.
it is placed altogether beyond dispute, that no man no one
of those has any regard for the interest of the public, that
in no one of them has any regard for any interest
other than that of the individual individuals, been the motive
in which the arrangement had its rise.

1. Take first the case of the Reversions.

When a vacancy taking place happening in any office
a person is thereupon put in into it to supply it, a circumstance
that may have place and is put too apt
to have place, is that the person so pitched upon
shall be but – in a more or less improper degree
well qualified to perform the duties of it. But this is a
risk incident to the nature of the case: be the office
what it may if it be a necessary one some person or other must be placed
in it, placed in it if not by men of fortune by which
no security at all for aptitude is afforded for placed by the choice
or some person or persons. In the selection made by them
for this purpose, an opinion of aptitude, and this as well
as absolute may for any reason proof that can
be assigned given to the contrary be the consideration is at least
using the considerations by which the choice was determined.
