But in this case, as in every other, in which at the
expence of one party money or money's worth is to be bestowed upon another
by the hand of a third, the title to this such money
is or contains in it contains matter of fact, which matter of fact, if it
be not purely ideal, and its existence asserted
without ground, is like any other matter of fact
capable of being substantiated. In the manner in which
when any matter of fact is capable of being substantiated, viz. by evidence and it is only in
proportion as evidence in proof of it is adduced, and that evidence
conclusive, that in the mind of any one who
thinks of it, any just reason can present itself for
any such belief as that the fact thus said to be
true is really true.
