Sinecures
It executes this itself, this law: – how so? In this
way and no other – for this cause by this means and no other –
because the pow on one hand the penalty which
it denounces in one count – on the other hand the
reward which it offers on the opposite count, takes
place of themselves, and without need of the interposition
of any Court of law to give cause them respectively
to take place. The continuance of the £38,000
a year is the reward which somehow other continues
to be offered for staving warding off the calamity of peace:⊞ and
that calamity has been staved warded off and continues to
be warded off accordingly. The so long as war has
continued so long as the calamity of peace has been warded
off, so long has that £38,000 or thereabouts continued
to be received: and that without need of action to be
brought, or so much as for the recovery of it, or so much
as message from above recommending the bestowal of it, with
Bill and Act of course.
The forfeiture of the £38,000 a year is the punishment punishment
which somehow or other has been continues in like manner continues to
be denounced against the minister by whose indolence
or deficiency in natural affection the calamity in
question, the calamity of peace was to be supposed to
take place:⊞1 ⊞1 But, for the buying
of this penalty neither
qui tam action nor indictment
nor formation
before Lord Ellenborough
which his
Lordship is so ready to
grant in all proper
cases⊞2
⊞ nor that other sort of
information which Sir
Vickery is so ready to
file in all proper cases
and to have denounced
couchant and
in all proper cases,
nor comprehend
before the House of Lords
to which their Lordships
are so ready to give
all proper effect in
all proper cases are
necessary, and of this punishment the execution being
thus in the one event as certain as effectually out of the reach of contingencies
and defeasances as that in the other opposite event of the remunerating law, so
is the efficiency of that peace-prohibiting law the
efficiency of which is thus by the united and double force of the two opposite
sanctions, and in both cases without need of recourse
the law proceeding, is effectually secured.
