Sinecures
viz. for the sake of certainty ignorance or negligence or ignorance and that if by the professional
agent of the party any one of those elements of legal certainty
were to be omitted, the party to whom the injury had been
done would be punished by the the Judges with the
loss of his cause: than which as anybody might see nothing could be more just
for that a specification of this nature was absolutely necessary
for the information of the Defendant,† who without it
would have known what to do, nor against what it was that
had to defend himself: and how it was that came the
specification of the dates, and with their etcæteras:
that between here might be seen an exemplification
of that strictness which on the part of the law was so necessary
to the preservation of life, property, liberty and whatsoever else
was dear to us.
On the other hand as to for law which is were to always bent
might be in danger of being more or less of its virtue
by way of compensation for the strictness so far as concerned
the numbers and even the species of the weapons that ought
to have been or might have been thus employed, a good
humoured latitude was allowed: and that it was in the within the
bounds thus prescribed marked out by judicial severity application of this latitude that the sportiveness of
the junior inhabitants of the offices is wont to find
a part of its relations: –
that an inventory of this sort in the character
of a component constituent part into the composition of the sort of thing that sacred sort species
of document called a Record: a document by which without
which legal demonstration and by which alone never could have been, as by means the
help of it, it has been placed upon a level with matters
material: and to which in consideration of such its irresistible
probative force by the Great Lord Chief Baron Gilbert
whose work on Evidence is by the great Mr Justice Blackstone
the application has been given of a diagram for the demonstration of
right
