But vast as the field is over which this rule exends,
no of it should be to give birth liable exposed to misconception
and for obviating such misconception, call for opposite
intimations.
The principal One misconception is that which regards the party
to whom the service is rendered: the party by whom
the whole prefe of the benefit, or if there be more
such parties than one, by whom the greatest part of the
benefit is received.
The case to which in a more particular degree
the need and use of this caution applies is that of judicial service.
The sort of service which is rendered by the execution of any
office concerned in the administration of justice.
The party who to a superficial glance is
apt to present himself be presented by imagination as the party to whom in
case of judicial service administration the principal part of
not the whole of what service is performed done is rendered
is the party suitor in the cause: at any rate
the suitor who from the termination given to the suit
reaps the principal advantage.
