tipling &c. to forfeit

void -
And be it further enacted that
every such victualler or other person licensed to sell
beer, ale, or spirituous liquors, in whose house
or cellar such person, or persons so tipling, or
gaming shall be found, shall, upon due examination
& proof thereof made by one, or more
credible witnesses before one, or more Justice,
or Justices of the peace, forfeit & pay the sum
of 40 Shillgs. for the first offence, and that if
such victualler, or other person, or persons licensed
to sell beer, ale, or spirituous liquors shall be convicted as aforesaid a second time of such
offence, his, her, or their recognisance entered
into at the time of obtaining such license
or licenses as aforesaid shall, on the production
of a certificate of such first conviction be extreated
into his Majesty's Court of Exchequer, and
that if such victualler, or other person, or
persons licensed as aforesaid shall be a third
