Of itself this is not enough to stamp the infliction with impropriety. For the service sought being by the supposition to the public a useful one, the suffering endured is the fault, not of the law, but of the offender. nor can he endure it without reaping what in his estimation is a preponderant advantage.

If not the punishment is not only groundless but sure to be inefficacious.

On this question then the propriety of it hinges.

1. Is it right that for warranting such practice of power should be given to any body that it is in the patients power to render the service sought.
