Punishment distinguished
Use of distinguishing them.
This is not a mere affair of words: from to these nominal distinctions
run it correspond some very important ones in
point of practise. The use† † This may be referred to Tit. "Punishment an expence": to be made of them
is to enable put a man to in the way of taking separate cognisance
of them, observing the several objects ends or purposes
to which the acts productive of these several consequences
may be directed, and so taking care
that no more pain or evil shall be produced
than what is put necessary to the attainment
of one or other of such ends or purposes. Such
or such a lot of pain evil, is it necessary for
the purpose of ordinary punishment? no. Is it
then necessary for self-preservation ? on the part of
an individual? on the part of the community?
on the part of the governing body? for safe-custody?
Is it a case that calls for the self-preservation,
for self-defence? for a personal obligation? for a
tax? for exacting compensation? for physical restraint?
for physical compulsion? If none of all these,
then the production of the evil is not justifiable.
The synopsis of these objects ought to comprehend
all the occasions on which punishment evil
is either intentionally or knowingly
produced.
