for the purpose of repelling the evil of fornication.
But the case is that neither the an operation of punishment
nor an act of restraint ought in any case
upon the principle of utility to be employ'd, unless
the total evil of the operation promises to be less than the
evil of the offence.obnoxious practice. Whether the evil resulting from
the legislative operation, viz: the excluding of Church Dissenters from
state-offices; or the evil resulting from the obnoxious practice;
viz: the maintaining by persons as well in as out of office the opinions and following the modes
of mischief maintained & follow'd by Church Dissenters

Lordship to examine; and the very point of all others
on which he has been silent. He has in
general terms the existence of the latter evil, but he
has no where adverted to the former, nor therefore drawn a comparison between the two.
