The punishment that a man suffers When a man is punished by being made to
do what he has a mind not to do his punishment
may be called active punishment:[a] when by being
made to suffer what has a mind not to suffer,
passive: by being restrained for either from doing
what he has a mind to do or from enjoying
what he has a mind to enjoy, restrictive.[b]

When this restraint or incapacity
is produced by a
change wrought in the condition
of his body, it may
be still referred to the
head of passive, and consequently
be brought under
that of corporal punishment

All corporal punishment then that is not capital
is either active, passive. or restrictive.

understood with reference to

[c] Active, to wit, on the part of him who is punished on whom the
punishment is inflicted: for on the part of him by whom it is inflicted [the punisher] every no
punishment can be otherwise than active must of course be active

[b] As to the distinction between a man's being restrained
from doing what he has a mind to do, or
from enjoying what he has a mind to enjoy, he
nothing turns upon it. For as nothing scarce any
thing that is desirable happens to us without some
sort of actions on our part, inflicting the the one
sort of restraint can scarcely be inflicted without
the other.
