Punishment
☞ Add for analogy use of the of
To a party assaulted in defending himself against the
assault, it has happened, suppose) intentionally or unintentionally,
to inflict in the assailant a quantum of
suffering equal to that which, with competent authority
from the legislator, the i would seem meet to the Judge
to inflict under the name and for the purpose of
punishment. Operating without this warning it might
happen to the Judge to reason thus –
"For self defence (a right which the law allows to b all
"persons in general in so far as it happens to them
"to be assaulted without legal authority,) for self defence
"the party injured in this case made provision
"with the his own hand. His part is thus done: but
"now for me – it remains for me to do mine. Thereupon
"comes a lot of punishment under the name of punishment
"comes a fresh lot of suffering which by the supposition
"is, the whole of it, superfluous."
