Yes – it does need to be said – and so much does it
need, that be it said ever so often such is the force of association, it will still
be said in – in this occasion as on every
other it is by the nature of the thing not that
judgment and conduct ought to be determined not
by the name. When it is unmeet, punishment
ought not to be applied. True; when it is
unmeet: that is where it is either groundless, or
needless or inefficacious or unprofitable.+ + Where it may
in cases in which it is not unmeet punishm not evil evil on the
score of punishment ought not to be applied.
