6. Safe-custody. Between safe custody and punishment
and safe-custody the relation of is of this
sort. To one and the same operation or factitious state
of things it may happen to be productive of both
or either of these effects.. is of either of them at p
But in the instance of the same individual person it is only as to a limited degree that there
can be a sufficient reason for making provision for
both at the same time.
To immediate extent Imprisonment for example always every where is, and
with propriety may be, – and every where is – applied
under the name and to the purpose of punishment.
In this case In so far as it is thus applied, safe custody
is a s state of beings necessary to be the existence and continuance of which is in part the same
thing with the intended punishment itself, in part in
a concomitant necessary to the existence and continuance
of whatsoever inflictions it may be deemed proper to add
to those which are inseparable from the safe custody itself.
But where no such thing as punishment But another case there is in which though is or at
least ought to be intended, because as yet no any ground for
punishment has not been and perhaps never may be
established in which ultimately for the mere purpose of safe-custody
that is of eventual forthcomingness, and thence mediately for the purpose of
imprisonment – an of the same name at least
as that which is employed as above for the purpose
of punishment is to a great extent administered.
