2. Conversely, by whatsoever in every case in which
in the case of every offence by which injury is done
to, and suffering produced on the part of a wound given to the feelings of an individual
by whatever evil is and in the shape of punishment
applied to the delinquent, good in the shape of compensation
or say satisfaction, vindictive satisfaction
is administered to the party injured.
From the contemplation of this coincidence result
two practical instructions.
1. Wherever a for the purpose of punishment, money
or other matter applicable to the purpose of lucrative compensation
is taken from an offender a delinquent, in such case, to the extent
of what is proper for compensation, give it to
the party or parties injured.(a) (a) Note on another page.
2. Wherever in default of or in addition to such
punishment as is applicable to the purpose of lucrative
satisfaction, punishment as applicable not to that the
purpose of satisfaction lucrative but only to the purpose
of vindictive satisfaction is administered, study to
give it whatever to the punishment that shape, may be it what it may
by which it may be best adapted to that collateral
purpose.
