Penal LabourThere is one division however of the punishments that come under this class which it will be of use to take notice of on account of the name. As the denomination of this division is altogether familiar and that of the whole class in a manner new, it may be of use on this occasion, to introduce the mention of the former that it may serve as an explanation of the latter. I am speaking of the Punishment of the Hard-Labour, a term that may be applied to any kind of work, in other words to any mode of action, and consequently to any punishment of the active class, where a considerable degree of bodily strength is exerted.Hard-Labour, as every one knows, be it of what kind it will, is more frequently applied voluntarilyspontaneously than in the way of punishment: for other purposes than for a penal purpose.
