Punishment – one lot may Serve
punishment was to answer the purpose of Example,
that is of general prevention.[a] Another set of Lawyers[b]
neither caring nor professing to care for any pecuniary
comforts or for the good of the community, are for having
you made to pay other ten pounds upon any body,
exacting it in his own name.[c] This third punishment
was to answer the purpose of Reformation, that is of particular prevention.[d]
To return to the Lawyers first mentioned set of Lawyers.
According to them if after you had been
made to pay (me) one of sum of these sums of ten Pounds upon
my exacting it in my own name, I were to exact have
exacted another ten pounds of you in my own name
there would have been no enduring it. If after
you had been made to pay ten pounds upon my
exacting it in the King's name, I or any one else
were to have exacted another fine of ten pounds in the King's
name, there would have been no enduring it. But if you
were

[a] This reason however is comparatively a modern improvement.
The original reason was the affront given offer'd to the King; the
disturbance given to his peace. The personal interest which
the King was supposed to have in having things quiet about
him is the only object which those who the antient Judges
professed to have in view. This idea runs through all their
forms.
[b] The Judges of the Ecclesiastical Court.
[c] By a mode prosecution which is called a Libel. For a personal
injury this lies only in the case where the party injured is an Ecclesiastic,
or the place where it is offer'd a consecrated place. The money
in this case is paid to I don't know who. See Ch.
