a man is said to possess – his person, his property
and his reputation.
NOTE.
To be understood apprehended, at least to be readily apprehended
one is obliged to conform one's self to popular discourse:
however inadequate and at bottom inconsistent incoherent it
may prove. at bottom. There are those to whom
the impropriety of the above phraseology will,
I make no doubt, be sensible. A man's person is
in reality the man himself, and is not any exterior
of the number of those external objects which alone
he can properly be said to possess. At the same
time this is the only one of the three objects which
the act that is said to be exerted on it is really
exerted on. A man's property⊞ ⊞ to wit for instance his house his land his money his household goods &c as well as himself
is of the class of really existent objects
is not any object which the act that is said to
be exerted on it,⊞ ⊞ meaning by act a motion of the agent, is one in general exerted on. It is
indeed where the object of property on which the punishment
is said to be exerted is destroy'd. But
this is not commonly the case. It is much more
commonly transferred than it is destroy'd. Now the an
act by which the transference of property is effected
is not any act that is exerted upon the property
transferred. It is very often, especially in the case
of moveable property an act of the sort of those
that are stiled intransitive:† † From the negative particle in and transico to pass. A verb imparting such a mode of action, is stiled intransitive by some Grammarians. an act that passes not,
that is not exerted, upon any object other than the agent: for instance an
act
