Simple modes of Punishment.
NOTE
strictly, be exerted. It is not any object, that can be said, properly
speaking, to exist. It is a mere fictitious entity.
Upon the whole, in the instance of person, the object
is real and the act really exerted on it: in that
of property, the object is real, but the act is not
in general really exerted upon on it: in that of
reputation, the object is not real, and for that
reason the act can not be really exerted upon on it.
Even here to avoid all inaccuracy, an exception
must be made. In the instance of those one species
of corporal punishment that come under the name
of Personal Corporal Restraint, such as I mean Imprisonment,
it is not necessaryily than any act should be exerted
on the person: who is the object of punishment:
without ever readying his person, it may be sufficient that
it may be exerted only on circumjacent objects.
A man may be subjected to Imprisonment [which
is a forced and painful situation] without touching
him or causing any thing to touch him, why sh
by only turning the key of a room which he
has entered perhaps of his own accord. Imprisonment
indeed when inflicted as a punishment, & by command of the
Magistrate, does not ordinarily commence in any
such way. It brought about by force, and does
not require the aid of surprize and stratagem
to effect. But whether it takes its commencement
or no in this way, it is in this way that it
has always its continuance.
