End of Punishment
Prevention of more importance than Correction
to wit, in point of extent. The circumstance indeed of
a man's having once offended in a particular way
already, affords a stronger presumption of his offending
in that the same way in future than can subsist
in the case of a person who has never been known
to have offended in that way. The mischief that may be expected
from him is greater in point of probability. Were
it not for this circumstance, the influence of which
it is in a manner impossible to estimate, and of
which at the bottom perhaps the influence is not very
great, one might determine exactly the relative importance
of these the two ends. The importance of General
Prevention would be to that of Particular,
as the number of persons having motives and opportunities
offences of the kind in question is to
1: that is, if the whole number of persons in
the community be po supposed to possess such
motives and opportunities, as that whole number
is to 1.
