Ends of Punishment.

When the physical power of doing a thing is taken
away from a man, he is said to be physically disabled
from doing it: he is said to be physically disabled for and with
respect to the act in question: to be laid or put under
a physical disability of performing it.

When a man is restrained from doing any thing
by dep expedients applied to his will or inclination
this may be effected in either of two ways. 1st by
stand
by destroying the desire of doing it: 2dly, that
desire still subsisting, by counteracting and pun overpowering
it by a greater and contrary desire. When
it is in the latter only of these ways that a man
is restrained from doing the thing in question he is said
to be deterred from doing it: when in the former way
the act being of the kind of manner ther number of those which are obnoxious,
he is said to be reformed.

When it is by the means of punishments provided
by the Law that desire of doing the thing is
surmounted torn down or attempted to be surmounted torn down, he is said
to be legally disabled from doing it, to be laid under a
legal desirability of doing it, in which case and then in many
instances cases for instance that of exercising an office
others on whom his doing it depends are laid in
the same way under a disability of permitting him
to do it.
