Ends of Punishment

Why upon the principle of utility it ought to be
the endeavour of the Magistrate to restrain the men
from committing in future the like mischief with that in question
is altogether obvious: there concern is so much less unhappiness
in the community the greater quantity of such mischief
is prevent. The reason is almost too plain
to be worth mentioning.

Why it ought to be his endeavour to make amends
for the mischief that has been done already, is not
quite so obvious: it depends upon two principles
which apply in two different cases, which we shall
come to [state] presently.

To make amends or compensation to a man for a mischief he
has sustained is to give bestow on him as much pleasure as shall
be equivalent to the pain he seems likely to suffer
in consequence of the mischief.

Now then this pleasure that is proposed to be bestowed
upon the man in compensation either can be given conferred
on him without expence, that is without putting
any one else to pain, or it can not. If it can,
the mischief a man he had sustained before affords not of in
itself any additional reason for bestowing on him this
pleasure more than there would be without it. For it
is always as much the duty of the magistrate as any
thing can be to confer on every pe man as much
pleasure as is in his power. This then affords
no reason for giving him the lot of pleasure in
question b rather than for giving it to another man.
