Difference between real punishment and apparent

produce the expectation of punishment; it is not necessary
that punishment in such a case should have ever actually
been inflicted. It is sufficient if it be effectually denounced.
The expectation of its being [to be] inflicted
comes of course.

To p.8 [Here again we must make another distinction:
which is between the actual infliction or execution of punishment
and the denuntiation of it: whether by the Legislators or by
those who him to whom where the it depends upon unwritten Law
it belongs to perform the function of the Legislator: to wit the Judge.] To produce
the apparent punishment, or in other words to produce
the expectation of punishment in the minds
of persons liable to become transgressors, one or other
in in every species of offence absolutely necessary:
but not both. The strongest expectation is certainly
that which is produced by the actual infliction of
punishment: but when Government is once formed
the denouncement of it answers the purpose very
well in general. The general habit and disposition
