Measure of Punishment.

I come now to consider the circumstances rules requisite
to be attended to in adjusting the quantity
of punishment.

If Any circumstance that be
Now if a circumstance rule be material in this
view it must be in one or other of two ways.
1st
By setting limits to the quantity of punishment
on the one side or more or the other: on
the side of diminution, or as I shall call
it for the sake of shortness, the minus side:
or else on that of encrease, in other words or, as I shall call it
on the plus side.[a]

NOTE.

[a] As these phrases are new, I will explain
them a little more particularly, in order to avoid
all possibility of being misunderstood.

A circumstance ule may be said to limit the
quantity of punishment in any case on the
side of diminution minus side, when it indicates that the
punishment ought not to be less than such
or such a quantity: on the plus side, when it indicates
that it ought to not to be greater. The
terms plus and minus cannot but be familiar
to every one who is the least conversant with
all algebraical expression.
