Measure of Punishment.
by the former rule the punishment must not be
less than the apparent profit. But 2dly
Secondly the apparent profit
Neither ought it to be less [even] than the apparent
profit of the crime: although the apparent profit
should be greater than the real. And this
for the purpose to answer the end of example,⊞ ⊞ as in the former case for that of correction. Where the quantum
of each is known by experience, it is may be enough
(for any thing that appears as yet) that the crime punishment of the be greater
than the real profit of the crime. But previous antecedently
to experience, the punishment, in order to have
its effect must in appearance be greater than the apparent
profit of the crime; how much greater so ever
that be than the real. The reason need not
be repeated.
The profit of the crime is very often certain
as being immediate: the want of punishment is
liable to a multitude of contingencies relative
to the⊞ ⊞ difficulty of detection and [necessary or unnecessary formalities of prosecution procedure. This
being the case, it is a 3d Rule that
The punishment must be as much greater [in
point of severity] than the profit of the crime, as
is necessary to make up the deficiency of the
former in point of certainty. The truth of this
is demonstrated by the foregoing reasons, it need
only to be illustrated. Let the apparent profit of the crime
appear to be certain as being immediate; and let the apparent chance
of incurring the punishment be as 1 to 2, and let the apparent profit
of
