Quantity of Punishment – by what considerations &c

A writer of consummate genius and discernment, has seems
through I know not what fatality, fallen to have given into the opposite
error mistake Smith's On the Wealth of Nations Vol. II, p.425, B 5. ch. 2. "The Law says he" (speaking of smuggling)
"contrary to all the principles of justice, first creates
"the temptation and then punishes those who yield
"to it, and it commonly enhances the punishment
"too in proportion to the very circumstances which
"ought to alleviate it, the temptation to committ
"the crime."[a]

This error is a very popular one, and as
writers of such merit have given into it, it must certainly
be a very specious one. It were worthwhile
therefore to probe it to the bottom.

But Qn. whether or rather this controversial part to the
concluding chapter "On False principles of reasoning &c
The Principle of Antipathy?
