Measure of Punishment

collect, supposing him to lend his employ his attention ever so
pointedly to that the circumstance of duration is this.
That it may the suffering may on one hand may
last as long as it is possible for the punishment mode in question
to last, and can not possibly last longer: on the other
hand that it may possibly last as short a
time as it is possible for that mode of punishment
to last: but can not be over over soon last as short. But
This we see leaves the matter very open and
indefinite: there is nothing here to arrest the attention
and fix it to the circumstance of time.
The probability is therefore that even in by men of
reflection, much more in the bulk [precipitate] inconsiderate
& hasty multitude, the circumstance of duration is scarce
at all attended to, but swallowed up in a manner
in the circumstance of intensity.

There is a remedy: but it is but a partial one,
this is to specify the precise time during which
the torture shall continue. This is highly proper
for the sake of the feelings of the criminal as
the time of execution: but it does not answer the
purpose of raising the apparent duration magnitude of the punishment in as far as duration is concerned to a level
with the real in the eyes of him who reads the
law.

The case is that those circumstances upon which the idea of
the apparent intensity may be heightened by
sensible representations; that of duration can not.

punishment
