is equally true with respect to every other kind
of punishment. It is very true that a man men
in general does not like to suffer the punishment of be punished with death, and
if it depended upon their consent they had their chance, would not
be punished in that manner. It is equally true
that men in general do not like to be punished
at all, and if it depended on their consent
would not be punished in any other whate manner
whatever
If the meaning be that no man ever consented has ever given such
consent previously to the passing of a Law to that
effect it is neither universally true, nor if it
were could it be any thing to the purpose.
In England Great Britain for example it is not true. It
is Death for example to forge a Deed. Now
A Law to this effect was passed in the late last
reign in the usual way by King Lords
& Commons. Now of the Lords and Commons every man who
voted in favour of this Law every man gave consent to
their his suffering this punishment of death in
case of his committing such a Forgery.
But if it were true, ? what would it prove?
just nothing, unless upon the supposition that
every government that ever subsisted subsists or by possibility
ever can subsist will have been unlawful. It is
not lawful, says the argument, to put inflict the
punishment
