NOTE
From 3 Humanity
impression upon the bulk of mankind than the justest
& closest arguments. As to the "Heart" nobody I believe I like to read of about it
has read of about it with greater delight than in
Heloise. But I can not help thinking the life
that in a treatise of penal Jurisprudence, the
less we hear of it the better.
The same Author not content with reprobating
all Punishment in the lump, attacks almost
every species of punishment it in detail.
Of perpetual deformation he tells us roundly
that in every case it is "contrary both to
"humanity and sound policy."# # p.52.
From the simple circumstance of being transferred
from the back and loins to the sole
of the feet the punishment of Beating is pronounced
to be "inconsistent with humanity" and
{what one hardly should expect} with decency": † † p.53. and "such
refinements of cruelty" we are told, "put the whole species
"rather than the criminal, to disgrace."
Mutilations and a variety of other modes of punishing,
[such as the description given of them] [so are
they described] are included under the same censure.
⊞ ⊞ To p.5. Thus in order to save the trouble of looking for the trouble would be too great to look for them [for it would be too much trouble to hunt them out] Afflictive Death is thrown out of the list of punishments
with as little ceremony. "We may pronounce
"it contrary both to sentiment and morality, to aggravate
capital executions by any circumstances of terror.
