In point of continuance, Mutilation is
not susceptible of distinctions like Deformation
and Disablement. Mutilation can be no otherwise
than perpetual. The privilege which
Nature has given to many of the less perfect
animals, the faculty of renewing their perished
members, is not communicated to man.[a]

There is no species of mutilation but what
was formerly in use in England. Whenever
an offence could be punished with death, it
could be punished instead of Death with Mutilation.
This was upon the ground of Common
Law:
