Mutilation.

No Mischiefs it
produces.

As to the mischiefs of Mutilation, over and above
the organical pain, these are those of Disablement
and Disfigurement united.

Notion annexed to it
by English Lawyers.

The deposition notion here given of Mutilation,
commonness is not very different from that
which our Lawyers of give of Maiming, or
as they write it Mayhem; of which they give
a definition considered as being the appellative of a species
of Crime. It comes as near it as any notion well
can so as to be consistent with itself.[a]

[a] NOTE

According to Lord Coke,† † 1 Inst. 126.b. Mayhemism est membri mutilatio; I membrum est pars corporis habens
destruatam operationem in corpore."
This
agrees pretty well with the above definition.
He goes on and says: "Mayhemism vero dici potent
ab abigous in abquâ parti suȓ corporis effectus suȓ inubbbi,
ad puguandum.
This latter part trows the matter
altogether into
Confusion begins to gather.

1 Irish 288.a
The same Lord Coke in another part of the same
book tell us that Mayhem signifieth a corporal
hurt whereby a man looseth a member by reason whereof
he is less able to fight. as by According to the same
Lord Coke in the a man looseth a member and is
in thereby rendered less able to fight in by any of the following cases: means 1
when by having his eye put out: ⊞ by having his
foreteeth beaten out:
3. by having his scull
broken. 4. by having his arm hand, finger, let or
foot
