Mutilation.

NOTE

some, that if a man's members should be good for
nothing but for fighting [fighting should be all that
a man's limbs were good for.
to fight with.

It may also be a
question whether that be the case be the same with female limbs:
and whether if it be, the amputation of the nails
as well as the teeth may not amount to Mayhem:
and whether if it be not, then be any harm it would be Mayhem
in destroying female limbs. to cut off a white smooth and tender arm. It might also be
doubted whether upon his Lordship's principles
if )at least upon some of his Lordship's principles)
however whether if Sr Walker Raleigh for example
had cut out his Lordship's tongue it
might not have amounted to a Mayhem, for the
same reason that it would have been Mayhem
in his Lordship to have cut out oft Sr Walter's
hand.

Pseudo-Mutilation

There are certain parts about the head, the expirtation extirpation
of which might, from an ambiguity of
language, be improperly taken for a Mutilation. though These
are the Nose and Ears. The Nose is the a organ
of smell; and the Nose may be cut oft. But it
is not the same nose that is the organ of smell
that may be cut oft; at least that may be cut off
entirely or as to put a total stop to the exercise
of that function. The organ of smell is a membrane
that lines more of the bone of the nose than can could be
cut oft extirpated without destroying life. As the cutting off of the
parts thus named has the appearance of amounting to Mutilation,
but does not so: I would call it Pseudo-Mutilation.
